I have had a sublet in New York for 1 1/2 years. I have been informed by the landlord that sublets are illegal. The original tenant now wants the apartment back. Even though his name is on the lease, I have been paying bills and rent (to the landlord) in my name the entire time. The landlord is aware of the sitation but does not want to get in the middle. He has said that we can change the lease to my name. What do I do next? Can the tenant take me to court since it is an illegal sublet? I do not want to move.
