What is the name of your state? NY

I am entering into a sublet agreement in a rent stabalized apartment. I know that my overtenant is allowed to charge me (subtenant) 10% over the stabalized rent since the apartment is furnished. However can the owner of the apartment demand an additional 10% on as a 'vacancy fee'?

If so, is that additional 10% charged to me (the subtenant) or my overtenant?

Meaning, is my rent really legal rent + 10% or legal rent + 20%.

I would greatly appreciate your help.
