What is the name of your state? Pennsylvania

I was fired July 5th for abandoning my position ( read patient abandonment) after requesting to leave early by 4 hours of a 12 hour shift due to mental stress.

(I felt I couldn't continue to due my job without making an serious error or saying something unkind to co-workers or patients and getting fired for that.)

I spoke to the nursing supervisor and charge nurse the only comment was from the supervisor who said "I have no one to replace you" I was never told I couldn't or shouldn't leave. I was never offered employee assistance for my stress. ( although the manager new I was in a long standing stressful situation).
My son and mother had recently died in the same week April of 2006. A new implemented computerized system caused the stress. It was implemented just 10 days prior with only 4 hours training and no support during a busy holiday time in the ER. the administrators took off for their holiday and left the entire staff to fend for themselves with no resource for a system fraught with real problems.

The HR person sent an email to my agency firing me effective immediately for abandoning my position.
I never abandoned anyone, I gave full report to 2 other RN's and they accepted that report. The supervisor lied to administration and told them, he told me, I couldn't and shouldn't leave.
Witnesses agree with me. He never spoke those words. My manager went to administration in my support after she investigated. I requested to be reinstated but it was never acknowledged. I had 7 days left in my contract with them. They are in search of another to replace me for 4 more weeks.


Can I sue for wrongful discharge? Can I sue for Libel? (E-mail stating I abandoned my position?)

You have no standing to sue for anything. Unless you can provide an employment contract which stipulates you must be given time off for 'stress' then you are an at-will employee and can be terminated for any reason.

Go take an English class then find another job.

While I sympathize with you on your loss, being told "I have no one to replace you" was the same as "No, you couldn't or shouldn't leave."

You should know that when you are assigned to a case you are required to stay until you are relieved.

You can loose your license for what you have done. So can you DON and the company you work for. Knowing this is basic to your training.

I feel for your situation but the whole holiday weekend, no one available to work is standard in the industry. Learn to deal with the stree of the industry or get out.
