My husband and I have been paying $50.00 automatically withdrawn through our debit card to a collection for a medical bill since May 2003. This month we were served papers to go to court and being sued on this debt. We had no idea what was wrong, so I called the company. They said they had not taken a payment out since May as my debit card expiration date was up then. They said they tried to call once and sent a letter once. I recieved no such phone call or letter and told them I had never even thought about sending them my new expiration date and it was all a mistake and they could go ahead and take out the 4 months of payments as I had already deducted them from my checking account. They agreed and said in order to stop the court proceedings which were 2 days later that I would need to pickup papers to sign. I got the papers and if we signed them we would be agreeing to a judgement for the amount owed, interest, and court costs. We did not agree to this as it was all unnecessary anyway and we do not want a judgement on our credit. So, we went to our "hearing" and spoke to thier attorney. She agreed was ridiculous, but we would have to set up a trial date to be able to explain our side and indicated she was going to talk to her client and try to get this all resolved before then. Since then we recieved papers from them to the court asking for a continuance and now will have to take off of work again for this. Since then, on the day of our court hearing they debited my account for the $200 and an additional $22.07 which we did not agree too and I assume are going to take out the payment for september as scheduled. Do we have a case here? How should we proceed from this point?

Well, $200 you agreed to let them take out. The $22.07 however you did not?
The $22.07 would be subject to question. Personally, I would have stopped all payment since it was going to court anyway.
I feel you do have a case, but some would say $22.07 is hardly anything to get upset about. I on the other hand disagree, today it is $22.07 what of tomorrow. :mad:
