What is the name of your state? Mich. I am shortly going to be going through a divorce. I have been told that I can possibly be held liable in the divorce for half his credit card debt, approximently $16,000.00, which I did not sign for, or have any knowledge of until collection agencies started to call my house. My "husband" is a gambler and I can prove it. I believe he was taking cash advances out to play, and will suppeona credit card co.'s if I have to for the records. He went bankrupt in 1997, and his work history sucks, I believe credit card co.'s. sent out those "pre-approved" letters, which ask for almost no information, and he started opening up these credit cards in 2000 or 2001. He has not worked since 1999, was home to get mail before me, and I did not see statements coming in. So, in the event I get stuck with 1/2 of these debts, I would like to, inturn, sue the credit card co.'s for that amount, plus attorney fees, court costs and any other damages that I could recover, for not doing the proper research when they issued these cards to him. Obviously, they did not contact any of the 3 biggest credit reporting firms, otherwise, they would have known he was a deadbeat. Anyone ever hear of anyone doing this before????........
