My husband has a workers comp case for stress against the city he works for. He’s about to have his disposition. He has recently filed with the EEOC for retailiation against ADA; also for revealing his medical information. The city was just served for (California) FEHA and the EEOC is considering federal charges.
He also wants to file charges for fraud against the city. He had hired a lawyer but because of many reasons (including duplicity and missed deadlines), the lawyer was fired. We didn’t want to miss this deadline so we sent an intent to sue (with the California Code that was violated) to the city attorney’s office. This was based on fraud that happened on July 15 and August 15 after he had returned to his job. The lawyer had told him we needed to file the intent to sue 45 days before the year was up. But we haven’t been able to find any information about suing a municipality in California and what the procedures and deadlines are; just how to file in California against a non-governmental entity.
We do plan to hire another attorney if the city won’t go along with mediation with the EEOC and if we can still sue the city. Where can we go for this info? Thanks.
