suing a contractor

i live in massachusetts and had new windows installed in my home. they have leaked since day one. the company has come out several times, but is just caulking around the windows instead of taking them out and installing them properly. they are still leaking and i am wondering how i go about suing them and what type of recourse i have.

Call up the window manufacturer and have them send a rep to inspect the installation. Then use the written inspection results.
