Suing my ex-fiance

My ex-fiance lives in another state and I live in CALIFORNIA. I was looking at a website to
get information on the Small Claims Court procedure in California. I read that the correct
venue to sue the defendant is in the city that he lives in. Is this a fact???

I need to know so that I can move on to the next step and get him served. I'm suing him
for the maximum amount, $5000, even though he owes me more. Can someone please
help me find out if I can still sue him even though he lives in another state? Is there any
way around this? It's been over a year since we've broken up and I think it's ridiculous
that he hasn't paid me back yet.

Much appreciated if anyone can help me!!!

Why does he owe you money? Broken contract? loan?

If you have a written agreement that he owes you money, make sure the document does not state where a lawsuit to recover from the contract can be filed.

If he just owes you money from loans you made and the promise to pay back is oral and the loan was made in California, you have a good shot at suing in California. if the money was lent in the state where he lives and then you moved here, he would argue that California is not the proper venue since he has no connection with the state.
