Can you sue school administrators for knowingly and admittingly after the fact, for not taking proper steps to ensure the safety of my child from another student from physical and mental abuse? In short my child was physically and mentally abused for 3 days straight before anyone took the proper steps to ensure her safety. Not once during that whole procedure was I, the mother, contacted by the school to let me know what was going on. I had to initiate the communication for this. After the student admitted doing it, and for 2 days after that being harrassed and threatened by the students gang, nothing in the way of punishment was invoked on her. My complaint is this....1. No communication by the administration at all and because what was done to my child was assult and battery, punishable by law, I should have recieved a phone call about it. 2. Lack of administrative responsibility to ensure the safety of my child once the initial attack was reported. 3. And all though they say it was a judgement call on the punishment of this crime, in the student handbook that they make students carry,it clearly states that assult and battery is punishable with out of school suspention or in school suspention, no punishment was giving. It has been 2 mths. now and still after repeated calls and meetings with the administration, we have come to no resolve. Do we have a case?
