Suing Turo for Damages in IL

Hello,

I'll make it short and simple. I rented a car via Turo and long story short, some junkie ended up wrecking my car. Details:

1. I had the best insurance package via Turo that is supposed to protect me; this includes ALL DAMAGE.
2. my car was in mint condition, and I have been renting it to people who drive for uber/lyft as well prior to Turo.
3. Have pictures that show my car prior to rental.
4. Have substantial proof my car was in perfect condition, including comments from previous rentals.

What happened:

This idiot ended up using my Acura MDX to move old junk. He ended up destroying my leather and left nasty grease stains in the upholstery. Also smoked in the car. Turo offered me 150 cleaning fee because my pictures don't have 'metadata' and can't they can't determine when they were taking thus deeming them invalid, which I told them to go xx themselves because my leather is ruined. That was actually where all correspondence ended and I haven't heard from them at all as if it's just going to go away.

Also, I never received any wages from the direct deposit. "What do you mean you never got it"

I literally never got ANY money from them. I signed up as a trial to see how it works. My first deposit kinda just disappeared in between them and me.


I'm also a Dr full time and I don't wanna deal with this. Basically, I want to sue them for every little thing. I want my car fixed, loss of income (like the insurance states) and so on. Also, I want my time to be worth my hourly wage. So, can I sue?

What does your contract say with regard to disputes between you and Turo?

Thank you so much for the prompt reply!! Basically, there is not that much info from the Turo side. I read all their rules and regulations and they don't have anything even listed that you need to take pictures prior to every single rental. Basically, they want a picture of the exact location of the damage prior to the trip, as if you were expecting it to happen.

That being said, is there a law that prevents companies from doing such things? Like, them not mentioning prior to rental exact specifications and requirements to process a claim as valid? It's the equivalent of winning a million dollars from a scratch off ticket, but then finding out from the admins that you didn't use the right coin, thus will receive nothing. I don't want to start posting pictures, but assume that I have most angles covered. Do I have good chances of winning extra damages? I REALLY don't want to screw anybody over/not looking for a handout...but I'm in Europe now for training and this has been an epic problem for me and a huge waste of time. That's the thing that's boiling my blood the most-I'm not a claims adjuster nor a lawyer, yet I have to take time away from my daily routine to take care of this.

You're not going to win "extra damages". This is a contract matter, pure and simple. Additionally, you don't seem to have the required documentation.

For hosts to qualify for physical damage coverage for any event that qualifies as a covered peril during the reservation period, Turo must have the following documentation: (1) clear photo documentation of the areas the host is seeking coverage for taken within 24 hours of the start and end of the trip; or (2) Other evidence (e.g. a police report, 3rd party report) that confirms the damage took place during the trip.

Thanks for yet another reply!! Much appreciated! I’m not familair with legal matters, but I’m pretty sure if they can’t handle the claim properly according to their own rules and regulations I should be entitled to compensation? When I say extra damages, I mean the money they owe me from their insurance policy aka loss of income and car replacement. Also, the time I’m going to put into this matter, that I have to take away from patients/my work. Also, I do have 100% of everything on that website you posted. They said that the PRE TRIP photos are invalid because they dont have metadata (tags that show time the pic was taken) and thus said the claim is invalid. It doesn’t mention ANYTHING about ‘metadata’. Also, in lue of the meta data I offered them other proof via car check ups, dealer report (everything was always done at the dealer).

From my end, I did everything I was supposed to to be legal and without ambiguity. This whole metadata came out of nowhere. Also, what about them not paying me wages owed?

I’m also trying to stress that this isn’t to fish out money. I’m just epically annoyed because if this happened in my profession people would be crying to the holy father about the injustice and I’d be sued instantly

I will do a break down and let me know if this would be valid in court!!

Turo officially charges a 200 dollar cleaning fee for smoking. They want to give me 150 with smoke + damages to leather and upholstery.

They guy went over my max allowed mileage by over 1k miles-286 dollars (turo priced it)

had the best insurance where they give you a car for 10 days up to 300 dollars

Loss of income (had to cancel like 3 listings because of this) and got nothing.

also, bumper was damages so 200 to paint it again.

detailing of upholstery(grease stains from old grill)

also, in terms and conditions, it says that guests cannot use the cars for commercial purposes.

I have valid proof for everyhing and did everything according to their rules and regulations.

o, and total amount recieved from turo till now i 0. that is Zero. never even got my money for the rental..they just keep saying they sent it and wont give me any other info. Im telling you this company is a nightmare. As of now my car has 3k miles extra, ruined interior, stinks, and got nothing. What a business

You must be able to prove the photos were taken within 24 hours before the start of the trip...you can't.

Do you have this? Did you have the police take a report about the damage that documents that it occurred during the trip? Or, do you have some other documentation that would show the damage occurred during the trip?

Generally, telling people to *insert profantity here* themselves will likely get conversation terminated. You might try being civil with people.

The junkie is the person who damaged your car, not Turo. If Turo is willing to insure you against damages while it is being used, that is a contract issue, so you must adhere to the conditions of the contract.

Many times when you email or text photographs from a telephone, the metadata is removed. If you still have the device with the images on it, try using another method to copy them.

I suspect that the OP doesn't have any recent (enough) pictures from prior to the trip.

You keep mentioning that you are doctor... so what? It has no bearing on the claim. You are not entitled to lost wages. The only thing about you being a doctor is relevant is perhaps to highlight your lack of judgment in dealing with an app based money making scheme.

The risk (the capital of car) vs the reward (the small payment you might get) seems like a bafflingly poor business venture.
