suit against apt, gate closed on my car

I posted a thread about 5 months ago, and I have a few questions regarding my case, first off, heres the situation....I was entering my apt complex, the gates have 2 sliding gates which meet in the middle when shut....the right side gate was non-functional and was broken open, the left side gate was working....as i entered the apt complex a child on a bike rode besides my car and darted in front of it in order to enter the complex.....i swayed my car just barely, a little left, in order to give the kid room as well as not to hit him...however, the child then stopped in front of my car and turned to look, so i was forced to stop my car....so now my car is more than half way through the gates and positioned a little left....then the left gate shut on my car...i couldnt see the gate because it hit behind the drivers side seat....my questions, its been about 6 months since it happened can i still file suit? can i sue for neglagance, if i get complaints filed about the gate before and after my incident? would a witness help if her car also got shut on, after my incident happened? im basically asking for any kind of help....estimates for my car damage is 1100 to 1400 dollars. Signs: one states "gates close automatically, not responsible for vehicle damage"....on the opposite side, there is a sign posted which says "exit only" on one of the gates...however no signs on the side i was coming in from....also, the gate was already opening when i entered....sorry about the long post....thanks

There is no way that this board, from your scenario, whether the apt complex is negligent because of the postings on the gates. It is just way to involved and complicated, not to mention the legalities and technicalities of the whole thing.

If you want to absolutely know the answer to all these questions I highly recommend that you consult an attorney in your area.
