I don't know if I should aks here or in the real estate section under landlord/tenants but here goes...I live in Arizona and am being sued by a former roommate. The amount of the the suit is for the future 9 months worth of rent even though there is a replacement tenant, so there is actually no money being lost by the roommate, the suit is just out of spite. I'm worried about the judge making me pay the amount as the roommate refuses to remove my name from the lease. The suit claims there is no replacement roommate and that one could not be found who was willing to sign a lease. Any thoughts? I do have both pictures and a witness to verify the replacement roommate, and am supposed to be getting a copy of the addendum where the replacement roommate signed onto the lease.

Then you have nothing to worry about.

If there was a "gap" between the time you left, and when a new roommate moved in, you'll have to pay for that time. But, you certainly won't have to pay for 9 months remaining on the lease.

I didn't evidence the new roommate until I was sued, so a month had past since I moved out. Is it my word against the other persons that there was a roommate present? I didn't actually see the new one move-in because I was gone. The landlord (who is unwilling to go to court) prepared an addendum to remove my name from the lease only days after I moved because my old roommate told her she had a replacement. I do have the addendum evidencing the date it was prepared, but I don't think that shows much proof of a replacement being there.

My response:

You're going to be just fine. Bring that with you to court, and watch as your old roommate gets laughed out of court.
