I own half of a 20 acre parcel zoned for heavy industry with my brother in law owning the other half. The bro in law wants all of the land for his business.
I want some of the land which is contiguous to a warehouse I own by myself. I have offered to split the property in half and then sell to the other owner several acres, but we have not been able to reach an agreement, and each of us has dug our heals in.
From a common sense approach, this land can be easily divided as it is just a large rectangle with ample road frontage and no improvements. It seems to me that a court/judge would grant this partition in kind, what am i missing? Could the court force us to sell even though the land lends itself to partition in kind? Is it a forgone conclusion that this will cost me big bucks to get a partition. Thanks for any help
