I received today from credit card attorney copy of Order granting summary judgment against me.

It may be a few weeks before my BK Petition is filed.

I have a few thousand in my bank savings / checking accounts that I intended to use for paying for BK attorney, and for other expenses.

I think they can freeze my bank accounts because they must know my account #s, from making past payments to them by checks.

Should I immediately take all money out, or put money in another bank they may not know about , before they can freeze account ? Can they question what happened to money that was in bank accounts, when they look at bank records ?

Were I you, I'd get that money OUT of that account ASAP ! I wouldn't deposit it in any other bank either, just to be safe. If you have to, leave a couple hundred in the account to keep it open if you want. If they won the judgment, they CAN freeze your account and drain it bone dry. If they don't ask you for bank statements, they're not going to know you had more money in there.

However, that process takes awhile.

Once a creditor gets a judgment, then it has to do proceedings supplemental in order to seize $ from your paychecks, bank accounts, etc.

You probably aren't in the emergency state yet, though I would get that BK petition filed sooner, rather than later.

Now, you should be aware that the BK will erase the debt upon which the judgment is based, but the judgment will still be on the books at court.

Your lawyer will have to make some additional efforts to get the judgment set aside, and there will most likely be an extra fee for that.
