Ok our court papers say BM is to let husband know by a letter no later than April 1 of her desired time for summer visits. Last year she called June 15 and said she wanted kids for her 30 days. This year we would like to know ahead of time. Since the papers state she must let husband know by April 1 or she automatically gets the boys from day school gets out in this case May 28th and they would be back by the 26th of June. If she does not give notice are we to assume this is her time and if she doesnt pick them up does he have to allow her to get them if her time has passed?? Can she just show up July 1 and say she wants the boys and would my husband have to hand them over? We are trying to plan a summer vacation with the boys. My husband has to give advanced notice on his request for vacation. So we really dont want to wait until the last minute.

If she does not contact you by the March 15, write or call her and remind her of the notification obligation contained in the order. Also inform her that if notification is not received on the 1st of April, that you (your husband actually) will complete his plans for vacation and that the children will be available for her to exercise her visitation during the Order's prescribed dates from May 28 to June 26th ONLY.
If the children are not return by the 26th of june at the prescribed time in the order, that an immediate show cause for contempt (two counts) will be filed with the courts.

ditto what BB said. And if that's the restriction in his visitation order, he can't just plan his vacation not knowing what her plans are.

Ok, thanks for the quick reply. This will only be the 2nd time she will have them for her summer visit. They will be 8 and almost 7 by the time her visitation comes around. Last year the 6 year old didnt get a birthday party. AS adults we know thats not to big of a deal but his brothers got one and he was very upset that he didnt get one. Besides getting to take a great vacation he can have a great birthday party.

Yes that is true but we are trying to plan it for the last week of July. The first week of April is plenty of notice for him to give his boss. We are plannign to go to Galveston which is 3 hours closer to Bm . Can we request she bring them there instead of to our home? It would make her drive only 5 hours instead of 8 1/2 hours.
