What is the name of your state? Il.
Hello, I have read numerous post and have one small question. When a NCP has 4 weeks visitation in the summer, is that NCP still responsible for CS those weeks? Or vice versa? I have no problem paying the CS, it just will be tight since I will have to pay daycare for those weeks while I am working. Thanks!

Im not a lawyer but my uncle has 5 kids (lol) and he takes them for a few weeks in the summer and he has to pay child support during that time and its a real burden since he has to feed and entertain them during that time and its 300 a week. But the court didnt budge one inch since the mother has them the rest of the year. Hope this helps.

The reason CS is generally not abated for summer visitation is really quite simple. Although child support is paid on a monthly/bi-weekly/weekly schedule, it is actually calculated as a yearly amount. That figure is then divided into some number of equal payments - 12, 26, 52. Technically, it would be possible to account for the summer visitation time, and then make fewer payments of a greater amount.

For example, suppose CS is calculated at $12,000/year to be paid monthly. That comes up to $1000 per month, for each of 12 months. OR $1200 per month for 10 months, if there are two months of summer visitation.
 
I am in florida....my ex husband gets a 50% abatement for anytime he has them for 28 days consecutivley.

Now my husband who was also previously married whose ex has custody of the kids and he has visitation....his summer is 8 weeks...he gets no abatement.

They were divorced in a different state.

I have a 1 yr. old with my curent fiance. Does this matter when calculationg support payments towards my child that I have from my 1st marriage. I'm in Illinois.
 
I have been told no by attorneys for myself and attorneys for my husband. They said it is not fair to take away from a child that one may pay child support on to take care of another that you may choose to have. Which makes sense....why should one child be denied the benefit of a certain amount of child support just because you go and have another kid.

Now my attorney (florida) told me that of you currently pay support on a child/children and then have more children and that relationship is terminated and you have to pay support then you can include the amount you were paying for the child/children prior to that relationship in a financial affidavit.

Only if you have a support order for the 1yo.
