I got 1-2 months behind in credit card payments due to a layoff. I continued to pay the credit card company when I could. Back to work now and can pay regular payments again and am 1 month behind (will not be behind at all as of next week).
I received a summons about 10 days ago and started checking online for info. Called the credit card company. Explained I had always paid on time before this happened (they agreed) and why I got behind. They said I needed to deal w/the lawyer because they have a contract w/them. Recommended I explain the situation to the lawyer and to tell them I'm willing and able to make payments.
On Monday I will file/deliver an answer to the summons along with a certificate of service and notice of appearance.
I cannot afford to pay a settlement at this time (debt is around $10,000). My questions are:
1 - Will the lawyer take monthly payments?
2 - I've been paying the credit card company and owe less than the amount in the summons. Will the lawyer work with the credit card company? Should I stop making payments to the credit card company?
3 - Should I call the lawyer or send a letter? If a letter is recommended, can anyone recommend wording? Should I be specific about how much I can afford to pay each month in the letter?
