The collections agency (hiding behind the name as a law firm) has filed a summons against me on behalf of Capital One. My court date is January 11, 2004. This is a non-jury trial. I was given a summons in July and replied to the court and the collections agency (via certified mail return receipt requestsd) asking for verification (not validation, as I learned after reading (I Won post)).
I never received any response from the collections agency. Can I use that as my defense when I go to court, for not verifying the information. I will show up.
