recently I filed for a due process hearing for my disabled daughter. The teacher put her in the hallway with a book shelf blocking the exit. Yesterday, we had an ARD meeting and the superintendent was present. When everyone left the meeting, he asked me to stay behind. He and the special services director and the ARD facilitor stayed. He told me if the due process hearing went all the way to the hearing, we would become advisories. I had already agreed to a mediation. Can he do this? It sounds as if he was threatening me. he also said the bookshelf wasn't very tall, and the teacher only put it there so my daughter could get a book. I told him that was not true, she put it there to block her. I have also filed a complaint with OCR and the justice dept.

What was the teacher's reason (if there can even be one) to separate your daughter from the rest of her class and put her in the hallway? What are her accommodations as specified by her IEP or 504 plan?

Without further information I would advise not going to mediation without legal representation. From what you've posted, they're trying to strong-arm you in order to keep their rears covered.
