What is the name of your state? California.

I'll give you the short version of my story. I'm a Canadian Citizen who crossed the border through Port Angeles by ferry approximitly a year ago. Because I crossed with just my ID & Birth Certificate, I don't have an I-94. I am going to be getting married in a short amount of time to my USC boyfriend of four years. I will then file for AOS. I received the packet today and saw form Supplement A to Form I-485 Adjustment of Status Under Section 245(i). Because I am out of status because of my overstay, do I need to file this form and pay the $1000 fee? I was told I just need to file I-130, I-485 and the corresponding G-325A's, I-765, Affadavit of Support, etc.
I have one more question if you can answer it, it'd be helpful. He is going to be using his sister as a co-sponsor for the Affadavit of Support, do they each need to fill out a form and his sister will need to include her tax return forms? She doesn't fill out the Contract between Sponsor and Household member as she doesn't reside in the same residence as us, does she? I'm not sure about that. I appreciate any advice you can give me. No, you will not need to submit the $1000 fee because you are not eligible for 245i. THat deadline passed on April 30, 2001 so it is not applicable to you.

As for your sister, if she is going to be the sponsor, she will have to sign the affidavit of support in her own right, not as a household member, since she is most likely not the household member and she will have to provide the last three years of her tax returns to demonstrate her earnings in keeping with the poverty guidelines.

My response:

The only "further assistance" you can give her Lana is to help her pack her bags. She's going to be leaving "Dodge City" fairly soon. Perhaps you can hitch a ride with her. Canada could us a good Orange County attorney.
