I live in WI..however pay child support to KY..my 18 year old son moved out of his fathers house the day he turned 18, however i am required to pay support until he graduates. my question is, is there a way to ensure or modify so the support goes to my son who is living with another family or to the family itself? i am not fighting paying however, i want to make sure my son is getting the benefit from it. it has been two months since he moved out and says he has no desire to move back in so i don't think it will be a temporary thing. his father admitted he has not helped our son out financially since he moved out but he refuses to make any changes. living 600 miles away makes it hard for a court battle so i'm asking if there is an easier way? since my son is 18 can HE request this from the courts??

You could petition the court to modify child support since the circumstances have changed or to emancipate your son since he is living elsewhere. In fact petition that father also pay child support to the family caring for your son.



KENTUCKY CHILD SUPPORT: Either or both parents may be ordered to provide a reasonable amount of child support, without regard to any marital misconduct, and based on the following factors: (1) the financial resources of the child; (2) the standard of living the child would have enjoyed if the marriage had not been dissolved; (3) the physical and emotional conditions and educational needs of the child; and (4) the financial resources, needs, and obligations of both the noncustodial and the custodial parent. Kentucky has adopted official Child Support Guidelines which are contained in the statute. These guidelines are presumed to be correct, but may be adjusted based on the following considerations: (1) a child's extraordinary medical or dental needs; (2) a child's extraordinary educational, job training, or special needs; (3) either parent's extraordinary needs, such as medical expenses; (4) the independent financial resources of the child; (5) the combined parental income in excess of the Kentucky child support guidelines amounts; (6) an agreement between the parents on child support, provided that no public assistance is being provided; and (7) any other extraordinary circumstance. In addition, the court may order a parent to provide health care insurance coverage for the child. [Kentucky Revised Statutes; Title 35, Chapters 403.211, and 403.212].

wow...never thought about that...is this somethng i should be able to just call the child support office and have them start the ball rolling?

i contacted the Child support office and they advised they cannot change the child support. as long as his father shows the custodial parent the money has to go to him. i asked about emancipation and they couldn't tell me anything about it other than i should probably get a lawyer :( any other ideas?

He's still in high school? When does he turn 19? Support ends at age 18 in KY unless the child is still in high school, then it terminates at age 19.
