What is the name of your state? florida

long story short-11 months or so after a bad night,this girl shows up at my house with a 2 month old kid that i never agreed to,wanted,however you put it-i was only told about him after she failed to convince another guy it was his-anyways,she filed for child support back when she came back here from virginia,and im tired of paying for her screw up-it was her bright idea to have the kid(after a pre-pregnancy coversation where i made it fully understood that i was in no way into or OK with having kids)
my question is what can i do to banish this misfit and all her crap from my life-can i sign my rights off,or what-her actions have caused me great anguish,and i just want to move on and straighten my life back out after her wrecking ball effect-WHAT DO I HAVE TO DO!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

You can take a paternity test and, if found to be the father, pay child support.

Other than that, you can do better at birth control in the future.

If it's your child, it's not just her screw up. If you didn't want a child you should have been more careful or kept your pants zipped. You didn't and now you are possibly looking at 17 years of child support. Regardless of whether you "wanted" one, you may have created a child. If you did, you're going to support it.

You will get as many CORRECT responses on this site as you have on the other site you posted on, you can post on as many sites as you want, the answers aren't going to change.

IF you are found to be the father you WILL BE ORDERED TO PAY CS- period- end of story.

It is your choice if you never want to see your child, know your child, or ever speak to your child's mother, you do have the legal right to do that. However, you do NOT have the legal right to decide to not financially support your child, no matter how much you wish otherwise.

You wouldnt be the first guy to get stuck with a kid you dont want. You wont be the first to have to pay for it. Sorry, that's life, and even though it sucks, that's how it is. You dont have to be involved with the mom or kid in any way, shape, or form, but if the DNA test says its your kid, you'll get to pay. But, hey, she's already tried to tell one guy its his kid, so apparently she might've been sleeping around. Maybe you'll be one of the lucky ones & it wont be your kid.

How sad it is when people have sex yet aren't willing to handle the consequences that result from having sex. Lucky that is is just a child, what if it was AIDS you had contracted. I think there is a lesson to be learned here and it's you should protect yourself and not just rely on the girl to be the one to take care of birth control.

What a piece of work you are. You made the choice to have sex. Therefore you made the choice to potentially have a child. (You did get sex ed in school, right? You do know how babies are made?) THAT was the point where you had a choice. If the child is determined through DNA testing to be yours, you will be responsible for helping to support him/her. The only way you might get out of it is if she has a spouse willing to adopt the child.

And if you think YOU have suffered great anguish? Imagine what the kid will go through if s/he finds out you're the Dad. :eek:

Spend the money and get a legally recognized paternity test. That will give you the definite answer as to whether or not its really your kid. If it is, even if you sign over all rights, you will still be required to pay support, unless she says forget and just stay out of their lives.

Not exactly, but kinda know what youre goin through.

Umm...not exactly. If you sign over your rights (read = terminating) you sign over EVERYTHING -- including the financial obligation to support the child.

Really? I was told that even if/when you sign off on all rights, you can still be obligated to pay.

There is a difference in what you two are discussing. If rights are terminated you no longer have a legal obligation of support. HOWEVER, if you just sign over your right to visitation/custody (in other words, give up the opportunity to be a part of the child's life and exercise your right of being there) then you still have a legal obligation to pay. Again this OP cannot terminate his rights. He can give mom full care and control of the child however that doesn't rid him of his legal obligations to financially support the child.

I used to think the same thing, and it may be true in other states, but I recently learned that in Florida (OP's) state, it is legal and possible to voluntarily TPR and still be ordered to pay CS.

My sister's ex has done this, the Judge allowed him to voluntarily relinquish his rights but he still has to pay CS. I was shocked when she told me that the Judge said that parental rights were one thing, but parental responsibily is another. I started looking into it and found that there is now an actual family law form for TPR, and a friend who works at CSE told me that it happens more and more often.

Just wanted to let OP know that a TPR isn't going to get him out of paying CS.:D
