I am 33 years old and my "biological" father is now challenging his paternity and is pursuing testing to prove that he is or is not my biological father. Based upon the result he intends to dispute the child support he paid until my age 18 and be compensated from my mother.

What legal action is he entitled too?

Well, he can prove or disprove his paternity to you, but other than that and the hard feelings it is likely to cause, he's not entitled to much. He raised you as his child, and the court is not going to take back the support order, or make your mother repay him at this late date for the child support. An attorney will inform him the same and other than his gretzing over paying for someone else's child for 18+ years, that's likely all you'll hear from him about it.

No no no.. he can not prove his paternity to our poster without their consent. If our 33 year old tells the father to take a hike, then there is nothing the father can do.

Of course, the rest if correct, even if the father does prove himself not to be the bio dad, there is nothing he can do about the money paid.

*on bended knee* Begging your pardon, LB...of course I did not mean that he could have tests done on a 33 year old adult without their consent, I merely meant the ability was there to prove or disprove his paternity. My most humble appologies for being unclear. ;)
