What is the name of your state? New York
3 years ago I purchased my property and was led to believe by the previous owner that there was more land on one side of the property than there actually was.My bank did'n t require a survey so we though it was great to save the money. The problem now is, after some increased activity around what I though was the property line I have relocated the survey pins and found a shed and a secondary well that we though were ours are on the next door neighbors property. On top of that the neighbor is the previous owners mother. I had problems with the previous owner for some underhanded tactics he used trying to get me to pay for work that the inspector said had to be done before the sale could go through also.Through it all my wife and I overlooked the problems and went through with the sale. I have offered to buy a small portion of the nieghbors land that I have been mowing and taking care of but they have refused saying they don't care if the shed and well are on their property we can use them as our own. My wife and I agree that would pose a major problem should we ever decide to sell. I believe they knew that this was the case all along and did not disclose the information. Can I sue them for the property or the cost to move the shed and well? WHAT CAN I DO?
