What is the name of your state (only U.S. law)? TEXAS

I have been married for 5yrs and my two kids want to be adopted by my husband. Will they lose their survival benefits from the biological father that committed suicide back in 2011. Also since I am the primary parent alive do we need to hire a lawyer to handle this since they receive survival benefits or can we do it ourselves.

Your children will not lose the survivor benefits if you remarry and your new spouse adopts your children. If you are younger than 60, however, you can lose your benefits.

It never hurts to review everything with a lawyer in your area.

Children do not lose survivor's benefits due to a stepparent adoption. However, it is generally best to use an adoption attorney. Adoptions, even stepparent ones are not generally a DIY project.
