What is the name of your state (only U.S. law)? New Jersey
My dtr was asked "not to return to school" because she was "not welcome" because another student reported that she told him she was going to kill him in a text message.
They immediately called the police who took over and began their investigation. When I questioned the school, neither my dtr's case manager (she has an IEP) nor the Vice Principal handling this "incident" admitted to actually seeing this alleged text message. They did not even get confirmation from the police that this text message actually exists.
However, I have seen and saved text messages on my dtr's phone from this reporting student that are definately threatening.
Yet, my dtr is "suspended" (although they refuse to call it that) and the reporting student remains at school.
What is the deal with this? What are my rights? The police have yet to contact me.
