What is the name of your state? California

I'm a 17 year old found removing UPC (tags) in Fry's Electronics from merchandises and replacing them with lower priced UPC - no damages to items or package. I then paid for the items though they were much cheaper.

I walked out of the store without paying the extra $312 that would have cost. I was stopped by security seconds after exiting the store and brought into the "back room." The security guard wrote a report and I signed.

The cops arrived and I was handcuffed and brought to the police department.
I was given a trial date and my mom picked me up. I'm expected to appear at the Pasadena Juvenile Court on 1/20/05.

I showed no restraint at all, cooperated with both the security and police, and gave everyone an easy time. The merchandise was recovered with no damages at all. I'm an A student and this crime was not premedidated (1st time stealing).

How will the court deal with my 1st offense case?

I didn't plan to remove tags when I entered the store.

A girl my friend knew told me how to get things for cheap. I was stupid enough to listen, though, I didn't believe it could work.

A couple days later I went to Fry's Electronics to buy a few things. While in the store, after I put merchandise in the cart, I thought about trying this scheme. Thus, my stupid actions were not premedidated.


I'm also planning on pleading guilty in court.

You will likely have to pay court costs, fine, restitution, AND will be on probation for 2 years or more for grand theft. At least I presume they are charging you with grand theft or some other felony. You're lucky if they went the easy route and charged you with petty theft.

Actually, petty theft requires under $400 in CA.

And you are lucky ... you could have been charged with the total value of the item and not just the difference.

MY RESPONSE: I knew you didn't know what premeditated meant. It doesn't mean "when you entered the store". If, before you did the crime, you thought about doing it for, perhaps as little as one second, then it was premeditated. That means you planned it, and carried out the crime. Even for a moment before it occurred.
