My wife passed away in April 2004. I had durable power of attorney since my wife was incompetent. My question is while my wife was in the nursing home in Arizona, my daughter took out a second power of attorney and had my wife sign over to her the deed to our home. Is this legal can you please advize.

POAs signed by incompetent persons are not valid. See an Elder Law attorney pronto. Check into fidicuary abuse and elder abuse. Hopefully, your wife had a valid will executed prior to her becoming incompetent. Your rights may be draining away....I hope you have that lawyer hired!
