Are tape recordings admissible in court for custody if you did not know you were being tape recorded? My hub would start things up with me...and secretly record it...so he sounded good and I of course sounded bad cuz he had it planned.

My response:

You're in big trouble, now !! Yes, in the State of Virginia taped conversations are admissable as evidence. Of course, he already knew the tapes were admissible.

Va. Code Ann. § 19.2-62 (Matthew Bender 1999): Despite the fact that it is generally a felony to intercept or disclose the contents of any wire, oral or electronic communication under state law, the recording or disclosing of communications by a party, or with the consent of a party, is specifically permitted.
