ILLINOIS-----Please I need some legal advice on what had happened to a friend of mine. She had found her phone had been tapped by her husband. She confronted him, and he threatened her with a saying, I can prove that she did it. When it fact its nothing but her talking on the phone the entire time. Then recently she found a video tape of them doing something that is not edited for TV. It plain as day on the tape she asked if the camera was on and he says NO..she wants to know what she can do to get him out or a restraining order. He has already barricaded her from leaving one night. I feel for her danger. The house is in her name. And he has followed her to the lawyers already. Please let me know so I can forward it on.

Illinois is an ALL PARTY STATE. everyone involved with the call has to know that it is being recorded.

If ALL parties are in a 'One Party' state, then only ONE party (ie, you) needs to know about the recording. You can record a phone call without anyone else's knowledge and use that information any way you want.

If ANY party is in an 'All Party' state then ALL parties have to be informed of the recording. If you record a phone call when ANY party is located in an 'All Party' state and they find out and have evidence, then you can be brought up on criminal charges, even if YOU are located in a 'One Party' state.

All Party States are...

California
Connecticut
Florida
Illinois
Maryland
Massachusetts
Michigan
Montana
Nevada
New Hampshire
Pennsylvania
Washington


So, if ANY party to the phone call is in one of the above states, you have to inform them of the recording or you could face criminal charges and civil damages.

She should go down to the local court house and file for a restraining order and have him removed from the house.
