I am being told by various individuals that work for my student loan company that a tax offset can not be reversed. I've made copies where it states that by Federal law I am to be notified of any offset before it actually takes place.

Can anyone help me with this issue? Are the student loan people correct or don't they have certain guide lines that need to be followed? If it states that an individual is to be notified of any doesn't that mean that have to notify you before or you can get your money back.

I'm willing to bet that if you take a close look at your promissory note, it's all there in black and white.

If you are in default, you should expect them to offset your refund. It's what they do.

It doesn't matter whether they notify you or not, if you owe them the money.
