I need some advice. I live with a man, we are not married and have 2 children. Every year one of us claims HOH and one child and the other claims Single and other child. Now we honestly didn't know, but each of us has claimed EIC and received it for the past 8 years! Now we just found out that only one of us is eligible for it. Now i received my refund , but his is being examined and we must send documentation for our son that he claims. Now I know this will bring my return into the picture. My questions. should we just send the paperwork they requested and wait to see what happens? How much trouble could we be in? We honestly didn;t know we couldn't do it that way, but I am sure the IRS won't take that answer. Please advise. thanks you for your time.

Go hire the tax lady - she'll talk to the IRS for you and negotiate a settlement figure. Don't make any big purchases. You'll need the money for the IRS.

I have a another question. Will one or both of us be required to pay back any money that we weren't entitled to? Actually one of us was eligible for the EIC every year. Do you believe we will actually need a lawyer or can we resolve this matter ourselves? We really don't have alot of money.

YOU WILL BE HELD RESPONSIBLE FOR ALL MONIES THAT YOU WHERE NOT ENTITLED TO...

ONLY ONE OF YOU MAY HAVE BEEN ENTITLED TO FILE HOH WITH 2 CHILDREN, AND THE OTHER SINGLE...IT ALL DEPENDS WHOE CHILDREN THEY ARE...I WAS UNDER THE IMPRESSION THAT THEY BELONGED TO THE WIFE.

BUT SEEKING ACCOUNTING ADVISE IS VERY IMPORTANT HERE, THIS IN MY OPINION IS NOT A
LEGAL ISSUE...IT'S A TAX FILING PROBLEM...

We are not married and the children are both of ours. I know they will amend returns and only one of us will be entitled to the EIC, and the other will not be and have to pay back what I or he wasn't entitled. I am just worried about what kinda of mess we're in?? From what i have been researching, one of us should have gotten EIC for 2 children, and the other single no EIC, so will they just amend all returns and change deductions and send a bill?? How far can and will they go back??
