Filed BK in dec of '01. I may have overpaid my income tax for that year. I'll be filing an extension so I won't know if I've overpaid until probably aug or sept. I realize that the trustee would claim that as part of the estate, but how will they know about the overpayment if I file my return after the case has been closed?

What if i apply the overpayment to my '02 tax return, will the trustee still gain knowledge of the overpayment?

In Indiana, if the trustee thinks the refund will be less than $2K, he won't be interested.

If it's more than that, he would be.

Does that give you some kind of idea?

If your refund comes after your discharge date, you owe no one an explanation of how the money is spent.
