What is the name of your state?What is the name of your state? NEW YORK

Recently my banking account was frozen, & I found out it was due to my wife's old debt (credit card under her maiden name) over 10 years ago & It caused checks to bounce & was hit with upteen amount of late payment fees. My wife is not currently working at this time & we are in the process in trying to resolve this matter. My question is, on a joint tax return, if we are to receive a refund does the assignee (credit card) be liable to hold our check against the outstanding amount owed on my wife's old debt?

Hi,

I've never heard of them taking your refund check for a credit card debt but that doesn't mean it's not possible. Usually it's for bad taxes, back child support, or defaulted school loans.

You can file an injured spouse form though and if they do decide to take your refund because of your wife's debt then you will still get your part of the return and they won't take your whole check.......

Any reputable tax preparer should be able to give you more info and help you file. If you file your own taxes, it's form 8379: http://www.irs.gov/pub/irs-pdf/f8379.pdf
