Technicality on Ticket?

Hi everyone,

Today I recieved a speeding ticket for driving 48 in 30mph zone. The officer wrote out the ticket and wrote down all of my information including driver's license number, size, height, etc...

The car is registered under my father's name, so my name isnt on most of the paperwork.

Anyway, the officer wrote down all of my information but my dads first name and middle initial. Since we arent the same size, height, etc... I think this could be used to get the ticket dismissed.

Should I just have my dad go to court and say, "This isnt my size or driver's license number, I shouldnt be getting this ticket."?

It doesn't matter they can still get you for the ticket b/c they had your correct dl#....why do you feel like you shouldn't get a ticket for speeding when you actually were? :confused:

Since we will in the same house, a ticket will arrive here with his name on it.
So if my dad goes to court, the cop never pulled him over - you cant give tickets to people you dont pull over.

My question is, would this work in the court?

To answer your question, I dont think it should be a cops duty to pull over teenagers going slightly over the speed limit. This cop was waiting at the bottom of a very large hill. This was a speed trap. I am an ethical person and take responsibility when I need to.

The police are here to maintain the peace and punish criminals. They should not be hiding in back roads on motor cycles at the bottom of a hill pulling over people going slightly fast to generate city income. Sure you can argue that its the police's job to enforce the law, but really, you're telling me you've never gone over the speed limit or rolled through a stop sign?

Even after he pulled me over and saw that I was a young guy driving a junker car, he could have given me a warning. It would have served the same purpose. By giving me a ticket, he just took $90 of hard earned money that could have gone towards my education.

Hope that put your question of ethics to rest :rolleyes:

Sure, it'll work if your goal is to get you and your dad thrown in jail.

160% of the speed limit is not "slightly over".

They are punishing a criminal who broke the law (you). Yes, I've broken the speed limit and rolled through stop signs. I've also been caught for this. What's your point?

He could have, but he didn't. It wouldn't have served the same purpose IMHO because you're trying to blame the fact that you got the ticket on the cop, not yourself! Next time you're considering breaking the law and speeding, maybe you'll remember that $90 and slow down.

Ture story dude. I was pulled over for speeding while I was being passed by another car - talk about messed up. The judge will probably be as hard as possible on you if you try to get a dismissal on your "technicality".

You best option is to admit you made a mistake, be a man and take your medicine.
 
My recomendation is to grow up and become a cop. Then you can give all the warnings you like and you can encourage your fellow officers to do the same. :)

What does how many lanes the road was, whether it was uphill, downhill, or flat, and where he was waiting have to do with anything? The speed limit was 30, you were doing 48. End of story.

:rolleyes: Wow, that's an intelligent response. You're going to be paying a $90 ticket and getting an insurance rate hike. Have fun! :D
