Hello:

I am a resident of Florida and am currently trying to find out what is legal to do with telephone and mail solicitation. The organization (or would it be company?) that I wish to start would be one like United Way- I would solicit money from people to then send on to other various charities, while keeping a percentage for myself. I don't want to get into any trouble and wish to do everything completely within legal limits. Any help on this would be greatly appreciated as I have not been able to locate very much information on the subject. Thank You.

What you are planning to do requires a very sophisticated knowledge of more than one aspect of law. I suggest you start off by reading the material the following links will take you to:

Here is a link to Chapter 617 of the Florida Code, relating to “Corporations not for Profit.” There you will find the state law relating to not for profit corporations, including formation and limitations on what you can do: http://www.leg.state.fl.us/statutes...tm&StatuteYear=2001&Title=->2001->Chapter 617

Here is a link to an IRS site where you can download for free IRS Publication 557, Tax-Exempt Status for Your Organization: http://www.irs.ustreas.gov/forms_pubs/index.html.
