I own a house that I'm leasing out through a property management company. The tenant we signed a lease with is breaking her 1 year lease only 2 months into it. I've read the lease over and over and the way I read it is if any part of the contract is breached by the tenant, then the tenant forfeits their security deposit. Period. My property management company says that if we find someone else to rent it for when she moves out, that they will give her back her deposit (prorated for any days the house is vacant). Can they do this? Again, I interpret the lease as if you break it then....no deposit back. What's the law on this? The house is located in Arizona. Thanks!

Technically the management is correct it Is ILLEGAL to have 2 people pay full rent for the same month on the same apartment.

Sooooooo Have the management company spend some of that security on cleaning up the place painting, washing the stove etc...and document the work, newspaper ads are deductable too.. and whatever little is left over send back to the tenant.

But if they find tenants who take the apartment as is and no money was lost in rent and no money was spent to advertise or repairs....well she could sue you in small claims court.

so do you feel lucky? then dont send her a dime.
