can a landlord in new york state say anything to a tenant that is filthy? other tenants in the building are threating to move if something is not done about it. don't want to loose them. need help right away one tenant is coming home from the hospital in a week and i need to get this problem fixed.When I say filth I mean roaches are showing up,possible fleas,and yes flies.Also the smell travels to downstairs and is horrible.

Define filthy. Does the individual look and smell like a bum or is the property unkept, unclean such that it could attract flies, roaches, rodents etc. If the latter, you have recourse.

It also depends on if the tenant is a rent controlled or rent stabilized tenant.... they have rights ya know!!!

The landlord has to give them a notice to cure the situation AND YOU have to be VERY specific about what the tenant has done to violate the lease, usually you give the tenant 10 days to cure the violation, if it is not done then the landlord will have to start eviction proceedings in court.

So you still have to define filthy.
