We live in California....

We have been waiting to move in to a new rental unit. The owner of the property has been going through the eviction process in order to get the current tenant out, so that we can move in.

So the landlord filed all the necessary papers, went to court, and even got a response from the tenant. The response was not an attempt to delay, but actually an agreement to move out by the end of the month.

Still, I know that the current tenant was bitter about having to leave, so when the time came to give up the keys, the tenant was nowhere to be found. All phone numbers have been disconnected and nobody answers the door at the apartment. All we know is that most of the stuff had been moved out and a few days ago the tenant said she would hand over the keys to the owner a few days ago. She has yet to hear from the tenant.

My questions is, how much longer will the owner have to wait to be able to get into this place if she cannot get a hold of the tenant? What is the process from this point forward? My family and I are anxious to move in, but have already been waiting a long time for this place....

Thanks for the reply!

Correct me if I'm wrong, but according to the link above, if the tenant or their belongings are not out when they were supposed to be out (according to the court proceedings) then the tenant has 5 days to get out before they can be physically removed? We think they might already be gone, but we are not sure. If they are, can the LL just go in? If not, do they then have to wait the 5 days to have the sheriff intervene?

We are all packed up and ready to go. The worst part is not the move this time, it's the waiting!!! :(

The LL should still go by the book and post 24 Hour notice before entering...
mayhaps the keys are on the counter ?

She hat to wait atleast 30day before she can start taking things out of the property...
