What is the name of your state (only U.S. law)? georgia
i currently live in an apartment and have for the last couple of years. the other residents and myself have been having problems with another tenant in our building. he is extremely loud, rude, and has actually gotten into physical altercations with other people in the parking lot, and was arrested recently for fighting in the parking lot and accosting another tenant when she asked them to stop. my question is what can we do to force the management's hand in removing this person from the property? he is obviously a violent person with no regard for other people and needs to be removed.

Is there an on-site manager(s) Are they aware of this dude?
Maybe they are already making steps to get him out?

Have others (besides the one incident where he was arrested) contacted law enforcement when they been accosted by this tenant?

Are folks who have had to deal with this tenant notifying management about these issues? Doing so would be helpful in giving management a legal reason to terminate this persons lease.

as far as i know 3 or 4 other residents have had conflicts with this person and have complained to management about it.

So what did they tell you? There's not a whole lot a landlord can do to get rid of someone with that behavior, that is, without police incident reports with some serious stuff. There's nothing illegal about being "rude" for instance. The management may want to get rid of this person as much as you do but there is often not a whole lot you can do to legally evict him, especially if he pays his rent and he's on a term lease. All the rest is usually just hearsay in an eviction court. It could be management are waiting for his lease to end, and with any luck, managements "gets it" and won't be renewing his.

they said they are waiting until they get a police report before they can do anything. i'm hoping with the property damage caused along with his arrest for assaulting another tenant will be enough to get him moved on out.
 
Well it sounds like your management is already doing all they can. They can't just put a person out on the streets without going through the legal process, which could take up to 6 weeks before he's out. And there's no use going to court until you have something solid to prove that he broke the lease (by breaking the law on the property). I'm not a lawyer but just talked to one this morning over something similar. good luck.

i also showed the manager that even though there are only two people registered to live there, there are over 4 people staying in the apartment, which is also a violation of the lease.
