What is the name of your state? New York
I just bought a Multi Family less than a Month ago. I took over all the leases of the Tenants living there. The one Tenant made the Paper today for Pleading Guilty for Forced Sexual Contact with a 16 year old. He is out on Bail awaiting Sentencing.
I have a teenage daughter and live in the building and one of the other tenants has a teenage daughter that lives in the building.
I am trying to find out what rights I have to get him out.What is the name of your state?
 


If you don't already have one, I would have all residents sign a crime free lease addendum making any crime of a violent, sexual or drug related charge a substantial violation resulting in immediate termination of the lease.

Check your STATE laws on how you can look up this information - all states have websites listing child sex offenders.

He will be sentences and in jail; however, warn current residents of his location and follow when he goes to jail and THEN serve everyone in his unit with termination notice.

Check your existing lease with the tenant. There may be a clause already in there stating immediate eviction for federal or state crimes.

If none are in your lease, you CANNOT evict him as he has not violated the lease agreement. Do as told, and send a lease addendum for future crimes as stated above.

That is a very serious dilemma. There is probably little that LL can do until tenant is tried and sentenced. Until such time, we are all “innocent until proven guilty.” In the future, a “Crime Free” Lease Addendum would be a viable option if legal in the state. (I have heard of a Drug Free Lease Addendum which is enforceable in many states, but not a “Crime Free.”) In the interim, contact the local police Sex Crime Unit to request their advice and knowledge about the matter to weigh your options as a LL.
