We moved in this community in July 2007, so we've been here 3 months. We never had a pre-inspection, but were given a checklist and told to turn it in within 7 days. There are a multitude of of repairs needed (approx 10 of them). The dishwasher has almost all of the prongs missing inside the racks, also the soap dispenser doesn't work. The garbage disposal doesn't work at all. The floor in the full bath wasn't put in correctly at the tub and water is getting under it causing mildew, just to name a few. We gave management some time, as they said they would get work orders done. A month later, nothing! So we write letters (we've written two) listing repairs, give them a date to repair by, telling them we will withhold rent to make repairs, still nothing! We didn't send them certified, but we know they received them, because they told us and said they would affect repairs, still nothing! The next one is going to be notorized and certifield, although i wanted to give them time to actually do something.

On top of all that, we have neighbors that are noisy and obnoxious, and our front doors are only about 15 feet apart, and we share that part of the front yard. Neighbors daughter/babysitter (not sure) has other teenagers over almost every night (approximately about 10 of them). They are noisy, swear incessantly, one of the boys has been bouncing a basketball and hit their porch light and broke it. Well...one night I had had enough and threatened to call the cops. The next morning the glass from their porch light was in my yard. Now we have a dog that uses that yard and I don't want glass in his feet and vet bills. So that day I got the camera and took pictures of the glass, their porch light with the house number near it, and she knew I did it, and I'm going to write a letter and send them to management. Then it seemed like all of the kids in the neighborhood were in my yard, some younger ones also (I would say 7 or 8 year old) and I caught one of them sneaking up to my door. I'm thinking he was going to try to come in and steal the camera, but I caught him!

Now we have already complained to management about this family and they did send a notice to them and the problem stopped for about a week.

I am at my witts end. I don't want to withold rent, as I know this only opens another can of worms, but I will do it if I have to.

Any advice??

Check with a lawyer before you withhold rent, or look up your state's landlord/tenant laws on the subject of habitability. I seriously doubt that a dishwasher that doesn't operate properly qualifies as making your life there untenable.

You can find out what the problem with the garbage disposal is simply by researching it on the internet.

We should not have to go to these lengths to have suitable housing, and maybe you think doing dishes for 4 by hand isn't a big thing, but try doing it, especially when there is supposed to be a working unit in the apartment. I have to run it twice to get them clean, thats twice the electric and more of My time. I can also take them to small claims court for those extra expenses.

That's what folks get for renting before the walk through making sure everthing works and is to their satisfaction.

By the time you run the washer twice you could hand wash and dry them , please .

In order to do so, the TENANT must PROPERLY follow their states LL/T laws BEFORE they withhold rent. You CANNOT just decide to do it one day. Failure to follow the appropriate steps will lead to an eviction.

I've done it before, it's not that big of a deal. If you're going to complain about it, don't have such a big family or make your kids do the dishes. Creates character.

If your try to rent withhold, you must follow the court's procedures for it. Rent withholding does not mean you simply don't pay rent for the month. It means you pay your rent, on time, to a 3rd party (like the clerk of courts or a special account). Failure to do this will result in eviction being filed. The idea is that the LL's rent is somewhere and is verified, but he can't access it until he effects repairs. If one simply fails to pay, there is no incentive for him to make repairs at all. BUt there is an incentive to file for eviction.

Since you don't really want to take this step, send him the certified lettter. While you can't fix the bath floor or the neighbors, you probably can fix the dishwasher if you are sightly handy. The soap dispenser is only a bad spring that makes it fail to pop open. You can learn how to change this yourself, or simply leave the dispenser open when you shut the door to the DW to run it. (Yes the soap will fall to the bottom, but that's what it does as soon as you turn it on and the compartment opens anyway. If you take the make and model number of the DW to a used appliance store (one that also does repairs) they probably have spare racks in their inventory. You can buy them for only a few dollars and just replace them. (Most only slide in.) They wouldn't be new, but who cares, they would work. And as Hot Topic said, you can find out what the GD problem is by some research. If it can't be fixed, toss those scraps in the trash instead until it can be replaced. Most rentals don't have GDs because they get clogged by tenants who don't know what they can or can't put in them. So we don't put them in a lot of places.

Send the leter certified to the LL and give him a reasonable time limit to begin repairs. Then call the clerk of court about your next step.

Thank you OHLandlord. I have done my research, and knew that I should open a savings account with the rent money to prove it is there and will be released if and when repairs are affected. If not I will get estimates and have them done with the rent monies. It looks like this is the only way at this point. Thanks again

**Some of you other people here should keep your opinions to yourself instead of voicing useless information. I rent because owning a home was too expensive repair wise, and I won't be expected to spend my own money to fix something they are supposed to, for one, I don't have it.**

Like OH LL I think this is a soap dispensing problem. Personally, I just grab a scoop of soap and throw it into the dishwasher. It works every time. :) but, I'm surprised you didn't think of it. You won't get much help with the neighbors if you withhold rent. I know I wouldn't. but then again I would not have rented property to a tenant in the condition you stated.

You should never rent on the promise of repairs to follow as the incentive to fix has left with the rent.
