homeowner owns a tenant occupied dwelling ...suffers a water damage claim......no formal lease agreement with tenant......it is a homeowners policy...is she still covered even though it is a homeowner's policy and may not actually list it as a tenant occupied dwelling? the property belonged to a family member and was left to her couple years ago...she has P.O.A. and just left everything the way it was when she "took over" got the property.....the tenant has been there for over 5 years...(Penna.)

as i'm sure you've guessed, a homeowner policy is written to cover an owner occupied dwelling. yet, there are other things to consider as well, ie. what type of poa? does it include insurance matters? is the owner deceased, is this part of an estate? is there a lienholder, that would have an insurable interest? is the claim just structual, or contents as well ? who owns the contents, tenant or owner?

is there a mortgage on the house, if so, the mortgagee has insurable interest .if the damage is structural and the loss is a covered loss, then the claim should be settled to protect the interests of the mortgagee, in my opinion.
