I live in Nevada. I am in a 12mo lease that started on 3/1/01. My rent is $1050/mo & I paid a $1250 security deposit at lease inception. Unfortunate circumstances have made me have to leave the state at the end of this month (June 2001). I have yet to pay my rent fpr June that was due on 6/1/01. I called the realty company to explain my situation & ask for them to keep my security deposit & let me stay to the end of the month. That is not good enough for the landlord & I was told today that I will be getting a 5 day letter. I have a wife & 2 small children & have nowhere to go & there is no financial help available to me. I understand the law is in the favor of the landlord since I have not paid this month's rent & I am still in the house & wish to stay till the end of the month. What legal rights do I have in order to stay here till 6/30/01? I have heard that if I respond to the 5 day letter with a plan then I may be able to stay. How do I go about this? Do I need legal representation? Will the plan have to include payment? The realtor has put a sign on our lawn today.

Consoider it a good sign that there is a sign on the lawn..

The sooner it gets rented the less you will owe.

So HELP the landlord re rent it asap....you are entitled to your security minus any costs or damages...but you will have to sue them in court since they probably wont send it to ya, but chances are you will have a court date soon..

DO NOT FAIL TO SHOW UP..... PERIOD.....NO EXCUSES!

If a new tenant rents it on July 1st you could be ok...since it is ILLEGAL for a landlord to collect FULL rent from 2 different people for the same apartment.

BUT if he cant find anyone till August 1st, you will be sued for July's rent as well as june's.
