Landlord owned a house and had a tenant on a month to month lease. Property was sold and tenant moved with the landlord to the next place. Landlord told tenant (via text) the security deposit was transferred to the next place (an apartment) to apply to that security deposit. Only the landlord was on the apartment lease. Landlord then purchased another house and broke the apartment lease (with tenants agreement) early to move into the home therefore losing the security deposit. Landlord verbally agreed that when the tenant moved out of the new house in 3 months the tenant would then get her security deposit back. Tenant all of a sudden decided to move out 2 months early with no notice and is demanding rent already paid and security deposit back. Legally does the landlord have to pay any money to the tenant? Original lease from the first home states oral agreements are under no circumstances legally binding and tenant must give 30 days notice of leaving. Is the original lease void since the property sold? If so is the security deposit supposed to be paid back to tenant even though they agreed to transfer it to the apartment?
