I am renting with 3 other people and 1 person moved out because of a petty arguement. Do i have the right to still charge him rent money for his stuff still being there after the 1st of the month? He said he would have it out a week before the 1st but he didnt and now its the first and he wants to take it out when he wants to. What can i do? his name is on the lease to.

You can't charge him anything as you are not the landlord.

With that said; if you have a definite period lease, yes, he is still liable for his share of the rent for the period of the lease. Depending on the situation, you may be required to mitigate (minimize) your damages by attempting to replace him as a co-tenant.

So, as long as he is liable for rent, or you want to consider him liable for rent, he has a right to leave his belongings in the apartment. He can also come and go as he pleases.

His things are still there = possession of the space = not moved out , the two of you can split his share and take him to court for non payment based eviction. if he completely moves out you both still gotta pay full rent and you can seek a replacement then sue him in small claims for the money you spent to make up his share (as long as the lease was joint with all 3 of you listed your all on the hook until you begin to make up that persons share of unpaid rent)
