What is the name of your state (only U.S. law)? GA

I currently rent out my basement (has its own private entrance and no access to upstairs) to a single female. The guy she is/was dating comes over in the evening about about 3 or 4 nights a week for the last 9 months. She told him to leave this morning and he refused. She called the police and when they got here they said he is considered to have residency and didnt have to leave. Then police told me if she moves out I would have to give him 30 day notice to leave. I only know this guy first name, he is not on the lease, he does not receive mail here, he doesnt have any property here (other than a hand full of clothes he just bought in last night) and he does not have a key. Police also said if he leave and she locks the door that he could break in, I dont understand that. Also I don't understand at what makes him have residency here. Please explain. Any advice on what I can or should do would be appreciated

According to the police he is no longer a guest. In fact if he was staying with her 3-4 nights a week, I'd make the same determintion. If you want him out, you will need to properly evict him. If you do not have his name, serve him as John Doe.

I would speak to a landlord tenant attorney immediately if she moves out and he insist on staying .

Does he have his belongings there ?

He doesn't have a key.

She leaves ,lock the door . Do not let him in .

If the police come they may tell you you have to let him in .
