What is the name of your state? ****land
Tenants' dog ate the arm of my couch. Not possible to repair as fabric cannot be found. I am asking for replacement of couch and loveseat (they are a matched set), less 3.5 years depreciation (10 year life) and salvage value of existing set. Tenants do not believe they should pay for loveseat. They broke house rules by allowing dog out of crate with no one home. To return me to original state (matched set), I require both (if shoes, would expect replacement for both shoes even if only one damaged). Thoughts?

This situation doesn't sound good, and i must agree.. it sounds like it needs to be before a judge.

If this is a funished apartment for rent, then you should have more leverage as the furniture is included in the rental. However, if you simply allowed them to use it without adding any clauses to yoru lease, i think you may have some more difficulty sorting things out.

Worst case scenario if you can obtain damages, is that they would only have to pay for the damage on the sofa. A judge will probably throw out the loveseat since it was not damaged if there is nothing specifically stating this issue in the lease.

Most important thing to remember is to be specific in the lease, and don't be afraid of offending anyone... leases are there to protect both parties. Good luck.
