I bought a two family house in NJ, and I got new tenants about 2 months ago. It was the understanding between me and the tenants that there would be no smoking in the upstairs apartment. This agreement has been broken, and my newly born son has developed medical problems due to it.(ear infections, pneumonia, asthmatic bronchitis) To make this problem even more difficult, I had a lease for them to sign, and they never returned it to me. After many requests, It seems that I am not going to get it. I have contacted the town and they suggested that I come up with a chargeable offense and file a complaint. Is there a chargeable offense, or is there another way to remove them from my house?

there is no reason for eviction, these people pay rent that is there apartment how are you going to tell them they cannot smoke in there own apartment. that is like telling them when they can take a bath how much water they can use, that is there life and there is nothing that is harming your child to the point it could be assult. And I dought your child is sick because they are smoking. They are in a totally differant apartment. You have no life and you are exadurating. get a life. There is no way you will be able to evict these people on those grounds. they didnt give you the lease back, it was your responsablity they signed it when they gave you the deposit. and they also are entitled to a copy. so stop finding things to pick at and get a life, and you might want to find out the real reason why your child is getting sick, drafty windows. or something but definately not the fact the people on the second floor are smoking give me a break..................

Dont mind my spelling I was in somewhat of a rush. But that really dont matter because I am sure you understood what I was saying. Sometimes I think faster than my fingers can move..................................... Believe me I am a college grad, with a bachelors in science, and I work in a law firm so its not how you spell its the point I was getting accross. Dont be mad at me cuz you have no life..... your nagging is probley the reason your child is sick, ear infections hmmmmmmmmm. from your big mouth. So just start minding your buisness and stop trying to say how people need to live there life. I think you might just be a control freak or something, try to control your tenents be happy you have ones that pay rent. Other wise you and your child could be in the dog house......................

Well since you dont have a signed lease by the these BOZO tenants, you have a month to month lease and you can give them a 30 day eviction notice today to be out by feb 28th, if they are not gone well start legal proceedings...

If they return the lease signed...well then you can also evict them for breaking the lease

No smoking means no smoking.... its your house you live there you can demand that from tenants... if you didnt live there it would be harder to enforce.
