Our Lease is Up Aug. 31st. and we have closing set at Aug. 7th. But I dont want to buy the cart before the horse so to speak. As i know the house isnt "MINE" until closing is done.

My current landlord, Manages a flooring CO. And I had to have her sign the rental verifaction, as she is a private lanlord and not commercial such as an Apt Complex. I also asked about getting a deal on flooring for the new house, and told her that we have closing scheduled for the 7th. she seem happy, as she knew when we moved in that we were going to be trying to buy a home. So I told here if all goes well this is a 30 day notice. She said no problem.

I know I need to give a written 30 day notice as verbal comes down to he said she said, at the same time I have 2 small children, and dont wnt to be without a place to live should the house fall through. What would be the best way to word this so if we get the house (forsee no problems, loan approved, house appraised, title is clear, but $hit happens everday) we are not responsiable for Sept. rent, but if it falls through I still have a house to live in.

Legally if we told her on the 8th we wanted to stay, could she turn us away?

You need to speak with your Landlord.

You can't have it both ways. You do not want to be liable for another months rent, but you also want the possibility of staying if the need be.

The LL can enforce your notice to terminate/vacate and evict you.
